Because at3tool can decode mono samples (mostly used in voices) that SonicStage can't.

If Sony is really poised to C&D emulators that make use of at3tool, it'll be interesting to see if they C&D JPCSP, as JPCSP has supported at3tool since a couple days after Fate/Extra CCC was released.

I doubt it will happen, though. I don't know of any noncommercial console emulator that has ever been C&Ded, even with similar questionable practices (supporting the GameCube DSP ROMs in Dolphin, for example).
It's not worth making experiements with Sony's patience.
Just to refresh your memory, Bleem was the first emulator that got a C&D. If you want a more recent example then it's the early version of what we call today Desmume. Companies are not stupids, they just wait for you to make the mistake and right now this is what's happening. Also I don't get the comparison with JPCSP's acts. I mean, if JPCSP would condone piracy then PPSSPP should follow? That doesn't make sense. Sony has proven that they are not one of those companies that stay inactive and we really don't want to be in the middle of the cyclone when they'll start attacking, especially now that somebody is working on ATRAC3+ reverse enginering. It's not worth the smallest chance of getting in trouble.
